![]() Marine Rescue Technologies Ltd. Terms & Conditions of BusinessAll goods supplied by Marine Rescue Technologies Ltd. (“The Company”) are sold subject to the following terms and conditions: General 1. Any variation of these terms gives notice to the customer is inapplicable unless accepted in writing by the company. 2. The company hereby gives notice to the customer that:- in the case of any goods supplied by it, resort may be had by the customer to the Manufacturer under the Manufacturers Warranty, should the customer have any grievance to the goods supplied. Price 3. Any Price quoted by the Company or appearing on any literature published by the Company is subject to variation without notice. Prices payable are including UK Taxes, Packaging and Carriage by means of our choice as the most suitable. Delivery and consequential damage 4. Whilst the company will do its utmost to adhere to any stated time for delivery, it shall not be liable for any loss or damage howsoever caused, by delay in delivery, it shall not be liable for any loss or damage howso-ever caused, by delay in delivery, completion, or performance of any contract, and any time stated in delivery shall not be a term of any contract or representation, and shall not otherwise be under any liability whatsoever. The company shall not in any event be liable for consequential damage or loss. Ownership and Risk 5. (i) No general property or equitable interest in goods supplied by the company to the customer (hereinafter called the “contract of goods”) shall pass to the customer until such time (hereinafter, called “the specified time”) as the price of the contract goods and all other monies (if any) due from the customer to the Company in respect of the contract goods or under any other contract between the Company and the customer shall have been paid to the Company in full. (ii) Until the specified time the customer shall be only a bailee of the contract goods for the Company and shall: a. so hold the contract goods until the specified time as to enable them always readily to be identified as the property of the Company. b. Redeliver the contract goods to the Company forthwith upon written demand before the specified time by the Company (iii) The contract goods shall be at the customers risk as from the moment of despatch from The Companies Premises Goods In Transit 6. Although the Company shall not be liable for any damage or loss caused by, or occurring during, transit of goods from the Companies premises, it will endeavour to seek recovery from its carriers the amount of any damage or loss aforesaid, but only if notification is given by the customer to the Company in writing within 3 days the same having been sustained. Terms Of Payment 7. Unless alternative Terms Of Payment are agreed in writing the customer shall make payment in Sterling by, Credit Card ,or, by arrangement with bankers cheque or cash, prior to the release of goods. Use Of Goods 8. The customer must satisfy himself that any goods ordered by him/her, are suitable for his purposes. The Company will not accept responsibility for any damage or loss directly or indirectly arising as a result of any recommendation. Return Of Goods 9. With the exception of paragraph 10 below, no goods will be accepted by the Company for Credit, Replacement or Repair unless previously agreed in writing. Invoice numbers must be quoted when returning goods. The company reserves the right to levy a handling charge in respect of returned goods 10. Upon final sale Goods and are none refundable in addition to point 5. Warranty 11. Marine Rescue Technologies Ltd (MRT) warrants to the purchaser that the products conform to manufacturers specifications and that the products are free of defects on materials and workmanship for a period of one year from the date delivered to the customer/end user. In the event of a defect, due to faulty material, design or construction, the customer will return to MRT at the business address were we, or the manufacturer will undertake, at our choice, a repair. Warranty covers all parts, materials and labour, provided that the product is returned to our works. Exclusions: damage caused by other than normal use and lack of basic, general care carried out in accordance with the instruction manuals. MRT Ltd. does not accept any responsibility or any claim for direct or indirect consequences of defects of the equipment, neither during the guarantee period nor at a later stage. Law Of Contract 12. Any contract entered into by the company shall be governed by English Law and shall be subject to the exclusive jurisdiction of the English Courts.
